These Terms of Service ("Terms") govern your enrollment in and use of online coaching services provided by Andrew Tolfa Coaching ("we," "us," "our"). By signing up for coaching, you agree to these Terms.

Agreement to terms

By purchasing, registering for, or using any coaching program offered by Andrew Tolfa Coaching, you confirm that you have read, understood, and agree to be bound by these Terms. If you don't agree to these Terms, don't enroll in or use our services.

You must be at least 18 years old to enroll. If you are enrolling on behalf of a minor, you accept full responsibility for their participation and confirm you have the legal authority to do so.

The coaching services

Andrew Tolfa Coaching provides remote fitness coaching, which may include personalized training programs, nutrition guidance, progress check-ins, and messaging support, delivered through the platforms we specify at enrollment (such as an app, email, or video calls).

Coaching is educational and motivational in nature. It is not a substitute for medical care, physical therapy, or professional medical advice, and no coach-client relationship formed under these Terms creates a doctor-patient or medical provider relationship.

Eligibility & health disclosure

You are responsible for knowing your own health status and physical limitations. Before starting any program, you should consult a physician if you have any medical condition, injury, or concern that could be affected by exercise, or if you are unsure whether you're healthy enough to participate.

By enrolling, you confirm that:

  • You have disclosed any relevant injuries, conditions, or limitations to your coach.
  • You will stop any exercise immediately if you feel pain, dizziness, or discomfort, and seek medical attention if needed.
  • The information you give your coach about your health and goals is accurate and current.

How coaching is delivered

Programs, check-ins, and communication are delivered through the tools we designate (for example, a training app and direct messaging). You're responsible for maintaining reliable access to those tools and for checking in as outlined in your program.

Response times for coaching feedback and messages are reasonable but not instant — we'll let you know what to expect for turnaround when you enroll.

Payment & billing

Coaching is billed on a recurring basis (for example, monthly) unless otherwise agreed in writing. Payment is due on the billing date shown at checkout, and your card on file will be charged automatically each cycle until you cancel.

If a payment fails, we'll attempt to charge your card again and may pause access to coaching until payment is resolved.

Cancelling or pausing your coaching

You can cancel or pause your coaching at any time, for any reason. There's no minimum commitment and no cancellation fee.

To cancel or pause, contact us using the details in Section 14, or use the cancellation option in your account if one is provided. Cancellations and pauses take effect at the end of your current billing cycle — you will not be charged for the next cycle, but you keep access through the period you already paid for.

Pausing suspends billing and program updates until you resume; it does not extend or refund the period you already paid for.

No refunds

All payments are final. We do not offer refunds for any coaching period, including partial months, unused sessions, or time remaining after you cancel or pause.

Because you can cancel or pause at any time with no future charges, this policy applies only to periods already paid for and does not restrict your ability to stop future billing whenever you choose.

Assumption of risk & release of liability

Physical exercise carries an inherent risk of injury, including but not limited to muscle strain, joint injury, cardiovascular events, and in rare cases, serious injury or death. By participating in coaching, you voluntarily accept these risks.

To the fullest extent permitted by law, you release Andrew Tolfa Coaching, its owner, and any affiliated coaches from liability for injury, loss, or damage arising from your participation in any program, except where caused by our gross negligence or willful misconduct.

Intellectual property

All programs, videos, written content, templates, and materials we provide are owned by Andrew Tolfa Coaching and licensed to you solely for your personal use. You may not copy, resell, redistribute, or share program content with anyone outside your household without our written permission.

Limitation of liability

To the maximum extent permitted by law, Andrew Tolfa Coaching is not liable for any indirect, incidental, or consequential damages arising from your use of our services. Our total liability for any claim related to these Terms or our services is limited to the amount you paid us in the three months before the claim arose.

Termination by us

We may suspend or end your coaching access if you violate these Terms, engage in abusive conduct toward a coach, or fail to resolve a billing issue after being notified. Where we end your access for these reasons, Section 7 (No Refunds) still applies to amounts already paid.

Changes to these terms

We may update these Terms from time to time. If we make material changes, we'll notify you (for example, by email) before they take effect. Continuing to use coaching services after changes take effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the state in which Andrew Tolfa Coaching is based, without regard to conflict-of-law principles.
